1. About this policy
This Privacy Policy applies to personal information collected by Bobbi Health Pty Ltd (ACN 690 319 316, ABN 61 690 319 316) (Bobbi, we, us or our).
It covers our website at www.bobbi.com.au (the Website), our comparison app at appv2.bobbi.com.au (the App), and any emails, calls or messages between you and us. Together we call these Bobbi’s services.
Bobbi is an independent comparison service. We are not a clinic, a telehealth provider or a pharmacy, and we do not provide healthcare. We help you compare providers across dentistry, orthodontics, optometry, audiology, physiotherapy, dermatology, fertility and IVF, men’s health, women’s health, weight management, mental health and sexual health, and, if you ask us to, we put you in touch with providers that match what you told us.
We handle personal information in line with the Privacy Act 1988 (Cth) (the Privacy Act) and the Australian Privacy Principles (APPs) it contains.
2. Key terms
Personal information
Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information or opinion is true, and whether or not it is recorded in a material form.
If information does not identify you and you cannot reasonably be identified from it, it is generally not personal information and this policy does not apply to it.
Sensitive information
Sensitive information is a category of personal information that the Privacy Act protects more strictly. It includes health information, as well as information about matters such as racial or ethnic origin, sexual orientation or practices, religious beliefs and criminal record.
We only use sensitive information:
- for the purpose you gave it to us for;
- for a directly related purpose you would reasonably expect; or
- with your consent, or where the law requires or allows it.
3. What we collect
What we collect depends on how you use Bobbi’s services. It may include:
- Questionnaire answers. For example, the category you are comparing, your state or postcode, how far you will travel, your budget, how soon you want to be seen, whether you prefer telehealth or in-person care, your funding (such as Medicare or private health insurance cover) and what you would like help with.
- Contact details. Your first name, email address and phone number, which you give us to see the names of your matched providers.
- Account details. If you create an account in the App, your login details and the comparisons saved to it.
- Communications. What you tell us when you email, call or message us.
- Technical information. Information about your device and how you use the Website and App, such as browser type, pages viewed and approximate location derived from your IP address. See cookies and analytics.
You do not need to give us your Medicare number, medical history, prescriptions or payment details to compare providers, and we do not ask for them in our questionnaires.
4. Health information
Some questionnaire answers can be health information, for example the type of care you are looking for or what you want help with. Health information is sensitive information. We collect it only with your consent, which you give by choosing to answer. You can stop at any time, and some questions offer an “I’d rather not say” option.
We use these answers to work out which providers fit what you need and to order your matches. We share relevant answers with matched providers only when you consent to that, as set out in section 7.
Mental health: your answer to “what are you looking for help with” is used only to rank your matches. It is not passed to any provider.
For more on what goes into your matches, see how we rank.
5. How we collect it
We collect personal information:
- directly from you, when you answer a questionnaire, enter your contact details, create an account in the App, or contact us by email, phone or online; and
- automatically, through cookies and similar technologies, when you use the Website or App.
If we collect information about you from someone else, we will take reasonable steps to let you know that we hold it and how we got it.
6. How we use it
We use personal information to:
- match you with providers and show you a comparison based on your answers;
- show you the names of your matched providers once you have given your contact details;
- share your details with the providers you have agreed to, so they can contact you;
- run your account in the App, if you create one;
- respond to your questions, requests and complaints;
- keep Bobbi’s services secure, fix problems and prevent misuse;
- understand, in aggregate, how people use Bobbi’s services so we can improve them; and
- meet our legal and regulatory obligations.
7. Sharing your details with providers
To see the names of your matched providers, you give us your first name, email address and phone number. When you submit them, you consent to us sharing those details, and the questionnaire answers relevant to your enquiry, with up to three providers you have been matched with, so they can contact you about their services.
- We share only with the matched providers, and no more than three.
- We share only what a provider needs to respond to your enquiry. Answers we have told you are private (such as the mental health answer above) are not shared.
- We never sell your personal information. For how Bobbi is funded, see how we make money.
Providers are independent businesses. Once a provider receives your details, it handles them under its own privacy policy and its own obligations as a health service provider. Bobbi is not responsible for how a provider uses or protects your information after we have shared it. Please read the provider’s privacy policy, and contact the provider directly if you want it to stop contacting you or to delete your details.
You can tell us at any time that you no longer want us to share your details. We will stop sharing them from that point, but we cannot recall information a provider has already received.
8. Other disclosures
We may also disclose personal information to:
- service providers who help us run Bobbi’s services, such as hosting, data storage, email and messaging, customer support and IT providers. We disclose only what they need for that work and require them to handle it in line with privacy law and this policy;
- our professional advisers, such as lawyers, accountants and insurers, where needed;
- a buyer or successor of all or part of our business, under appropriate confidentiality arrangements; and
- government agencies, regulators, courts or law enforcement, where the law requires or allows it.
Maintenance and support staff may see personal information from time to time in the normal course of their work.
9. Direct marketing
We may send you updates about Bobbi’s services from time to time. We will only do this using information we collected from you directly, and where you would reasonably expect us to, or where you have agreed.
We do not use sensitive information, including health information, for direct marketing. Every marketing message includes a simple way to opt out, such as an unsubscribe link. You can also ask us to stop at any time by emailing [email protected].
10. What stays in your browser
Many people compare healthcare on a shared or family device, so we keep as little as possible in your browser.
- Questionnaire progress on the Website is kept in your browser for the current tab only. It is removed when you close the tab and expires after 24 hours.
- Your name, email address and phone number are not stored in your browser.
- If you use Upload Script and attach a photo or PDF of your script, the file stays on your device. The Website does not upload it to Bobbi. You share your script with your new clinic yourself, during your consult.
11. Cookies and analytics
Cookies are small files that a website stores on your device. We may use cookies and analytics tools to keep Bobbi’s services working, remember your settings, understand how people use the Website and App, and improve them.
We design our analytics so that your questionnaire answers are not sent to analytics providers. Where we use analytics, we aim to use information that does not identify you, such as which step of a questionnaire was reached rather than the answer given.
You can block or delete cookies in your browser settings. Some parts of Bobbi’s services may not work properly if you do.
12. Storage, security and retention
We store personal information in a way that reasonably protects it from misuse, interference and loss, and from unauthorised access, modification or disclosure. Access is limited to people who need it to do their job.
We keep personal information only for as long as we need it for the purposes in this policy, or as the law requires. We currently keep contact details and questionnaire answers for [retention period]. When we no longer need personal information, we take reasonable steps to destroy it or de-identify it.
If a data breach is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.
13. Overseas disclosure
We generally do not disclose personal information to overseas recipients. Some of our service providers may store or process information outside Australia, including in [countries]. Where this happens, we take reasonable steps to make sure they handle it in line with the APPs, or we disclose it only as otherwise permitted by the Privacy Act.
14. Using Bobbi without identifying yourself
You can browse the Website and read our guides without telling us who you are. You can also answer a questionnaire and see anonymised results without giving us your name or contact details.
To see the names of your matched providers, or to have them contact you, we need your first name, email address and phone number.
15. Access, correction and deletion
Under the APPs, you can:
- ask for access to the personal information we hold about you (APP 12); and
- ask us to correct personal information that is inaccurate, out of date, incomplete, irrelevant or misleading (APP 13).
You can also ask us to close your App account and delete your personal information. We will do so unless we need to keep some of it to meet a legal obligation, in which case we will tell you what we have kept and why.
To make a request, email us at [email protected]. We may need to confirm your identity first. In limited cases the law allows us to refuse access; if we do, we will tell you why in writing. Requests that reach providers you were matched with need to go to those providers directly.
16. Complaints
If you have a complaint about how we have handled your personal information, please contact our Privacy Officer using the details in section 18. Tell us what happened and how you would like it resolved.
We will aim to respond within 30 days of receiving your complaint.
If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
17. Changes to this policy
We may update this policy from time to time, for example if Bobbi’s services or the law change. We will publish the new version on this page and change the date at the top. If a change materially affects how we handle information we already hold, we will take reasonable steps to let you know.
18. Contact us
